These General Terms and Conditions (hereinafter referred to as ‘GTC’) apply in the version valid at the time of conclusion of the contract and are binding for all business relationships between she ceramics (hereinafter referred to as ‘she ceramics’ or ‘Company’), Zurich, and its customers, i.e. legal entities or natural persons or partnerships. They form an integral or supplementary part of all contracts concluded via the online shop (www.she-ceramics.ch), by telephone, by e-mail or in any other way suitable for concluding a contract. Any terms and conditions of the Customer that conflict with or deviate from these GTC shall only apply if she ceramics has expressly agreed to their validity in writing.
The products, services and prices published on www.she-ceramics.ch are deemed to be binding offers, subject to their accuracy.
The contract is concluded as soon as the customer places an order via the online shop or by other suitable means. The automatically generated confirmation of receipt does not constitute an assurance of the actual availability of the ordered products, but merely confirms receipt of the customer’s order by she ceramics.
If the customer orders an item whose price is incorrect or which is not available, the parties enter into a contractual cancellation relationship in which all services already rendered are to be refunded. Any shipping costs incurred by the Customer in connection with the return shall be borne by she ceramics. Further claims by the customer, in particular claims for damages, are excluded
Acceptance of the offer by the customer is generally binding and irrevocable. Exceptions are possible in certain cases, but are at the discretion of she ceramics and may be subject to cancellation costs. In particular, compensation is payable for the negative contractual interest plus the reduction in value of the products ordered, but at least CHF 30.
The customer is obliged to accept the ordered products. If he does not fulfil this obligation, she ceramics may cancel the contract and charge the handling costs in accordance with Clause 3 of these GTC.
she ceramics sells handmade ceramics. Minor external differences between products of the same type or between the product images published on www.she-ceramics.ch can therefore not be ruled out. Courses and Open Studio Memberships are also offered.
Every registration is binding and is paid for online at www.she-ceramics.ch by credit card, Twint or other payment systems. All courses, unless otherwise defined in the product description, are from the age of 16. After registering for a course, the participant will receive a confirmation of registration from she ceramics.
she ceramics reserves the right to cancel courses due to insufficient demand and without giving further reasons up to 5 days before the start of the course. In such a case, the participant has the option of taking part in another course as an alternative or reclaiming any payments already made in full.
In the event of cancellations due to force majeure or beyond the control of she ceramics, she ceramics has the right to offer an alternative date or to offer the course value in the form of a voucher for other courses. A refund of course fees is not possible in such cases.
Cancellation of course participation by the participant is possible up to 7 days before the start of the course. If the participant cancels the course at a later date, 100% of the course fee will be due, even if the participant fails to attend the course without good reason.
she ceramics reserves the right to exclude participants from a course. In the following cases, the full course fee is owed, i.e. there will be neither a pro rata refund nor a waiver of the course fee: exclusion from the course due to non-payment of the course fee and in serious cases (defamation, harassment, deliberate damage to property, etc.).
For exclusive or individual courses, group bookings, birthdays, company and team events or other courses, the following cancellation guidelines must be observed.
Up to 90 working days before the event: the costs incurred will be charged
89- 60 working days before the event: 25% of the agreed service
59- 30 working days before the event: 35% of the agreed service
29- 14 working days before the event: 50% of the agreed service
13 – 7 working days before the event: 75% of the agreed service
6 – 0 working days before the event: 100% of the agreed service
No-shows cannot make up their courses and the costs will not be refunded.
In principle, products cannot be exchanged or returned. Exceptionally, an exchange or return may be made at the discretion of she ceramics. The price valid on the day of the exchange is decisive. Special customised products are excluded from exchange or return.
she ceramics endeavours to ensure that the prices and availability details on www.she-ceramics.ch are up-to-date and truthful. However, delivery bottlenecks, incorrect stock data, technical problems or human error cannot be ruled out. All information on products, services and prices is therefore provided without guarantee and is not to be understood as a warranty. No liability can be accepted for the accuracy, completeness and up-to-dateness of the published information. Impossibility of delivery or incorrect price information constitute contractual grounds for cancellation in accordance with section 2 of these GTC.
All published prices are to be understood as final prices excluding shipping costs.
For the articles shown on the website, the prices are in Swiss francs, including VAT. The shipping costs are based on the weight of the goods and are calculated and displayed during the sales process: Shipping within Switzerland minimum CHF 8.00.
When purchasing products containing alcohol, the customer confirms by accepting the GTC that he has reached the age of 18. she ceramics is authorised to make enquiries at any time.
10 Terms of payment
The customer is obliged to pay the invoiced amount within 30 days of the invoice date. Unless he has already paid the amount during the ordering process by credit card, Twint or other payment systems.
If the invoice is not paid within the aforementioned payment period, the customer will be warned. The company reserves the right to demand payment in advance at any time without giving reasons. Offsetting the invoiced amount against any claims the customer may have against the company is not permitted.
Discounts or vouchers are only accepted subject to the conditions shown on the voucher. A voucher code or value is entered during the payment process. Discounts not claimed during this process can no longer be granted retrospectively. Discounts cannot be accumulated.
If the customer fails to fulfil his payment obligations in whole or in part, all outstanding amounts owed under any title shall become due immediately and all deliveries shall be suspended. In addition, default interest of 5 per cent will be charged without prior reminder.
From the second reminder, she ceramics is entitled to charge the Customer a collection fee of CHF 15. she ceramics reserves the right to pass on collection procedures.
If a Customer defaults on payment or commits any other breach of contractual obligations, she ceramics reserves the right to unilaterally withdraw from the contract at any time.
The goods remain the property of she ceramics until the purchase price has been paid in full. She ceramics is entitled to enter a retention of title in the retention of title register at the Buyer’s expense if it considers its claim to be jeopardised.
Delivery is made to the delivery address specified by the customer at the time of ordering. The shipping costs are calculated and shown on a case-by-case basis and are listed before the order is placed.
If goods are delivered by a haulage company, the customer must check the delivery for transport damage upon receipt. With his signature, he confirms the visual integrity of the delivery, unless a reservation is noted. In this case, she ceramics’ liability for visible transport damage is excluded. This does not apply to hidden defects.
The Customer must inspect the goods for any defects immediately upon receipt. Corresponding complaints must be brought to the attention of she ceramics within three days. Likewise, hidden defects that only become apparent during the warranty period must be reported within three days of their discovery. If the customer fails to give notice of defects in due time, the goods shall be deemed to have been approved. Warranty claims against consumers shall become time-barred in accordance with Art. 210 of the Swiss Code of Obligations two years after delivery to the buyer; for business customers who are not covered by Art. 210 para. 4 (b), the period shall be 12 months. An individual, express and written agreement on the exclusion of the warranty between the parties remains reserved.
she ceramics sells handmade ceramics, therefore negligible impairments such as minor deviations from the published image alone do not constitute grounds for return.
she ceramics can fulfil the warranty either by replacing the item or by refunding the purchase price paid.
If the Customer wishes to return defective products to she ceramics, he must bear the costs (incl. customs clearance, VAT, etc.) and risk himself. A copy of the purchase invoice must be enclosed.
Claims for damages arising from impossibility of performance, from breach of contract, from culpa in contrahendo and from tort or for any other legal reason are excluded both against she ceramics and against its vicarious agents to the extent permitted by law, except in cases of wilful misconduct or gross negligence. No liability is accepted for consequential damage resulting from the use of the products.
Under no circumstances shall the purchaser be entitled to claim compensation for damage that has not occurred to the delivery item itself, such as loss of production, loss of use, loss of orders, third-party claims, loss of profit and other consequential and indirect damage.
In general, she ceramics rejects any liability if personal items are lost or damaged in the studio. she ceramics rejects any liability for injuries or accidents.
If the company, its suppliers or third parties involved are unable to fulfil their obligations on time due to force majeure such as natural disasters, earthquakes, storms, unrest, etc., the company shall be released from the fulfilment of the affected obligations for the duration of the force majeure and a reasonable start-up period after its end. If the force majeure lasts longer than 30 days, the company may withdraw from the contract. The company shall reimburse the customer in full for any payments already made.
Any further claims, in particular claims for damages as a result of vis major, are excluded.
The stored data is used exclusively for operational purposes, in particular the fulfilment of obligations arising from the purchase contract and the dispatch, maintenance and administration of a newsletter, unless the customer expressly excludes the receipt thereof. The forwarding of user data to third parties for operationally necessary purposes is authorised. No liability is assumed for the security of the transmitted data. The Customer is obliged to provide truthful personal details. she ceramics reserves the right to delete Customer data or block a user account at any time and without giving reasons.
The Customer agrees that she ceramics may take photographs and video recordings of the Customer and participants for whom the Customer has made a booking or transferred a booking to them during the on-site courses and may use these for advertising purposes itself as well as pass them on to third parties and publish them. This authorisation and the associated rights are valid for an unlimited period of time and geographical area, for print and online use. The customer and any participants for whom they have made a booking or to whom they have transferred a booking have the opportunity to declare in writing to she ceramics before the start of the booked course that they do not consent to the creation of photo and video recordings of themselves and their images. The declarations must be sent in writing to hoi@she-ceramics.ch.
Subject to mandatory statutory provisions, the place of jurisdiction and place of fulfilment shall be Zurich, Switzerland.
The contract is subject to Swiss law, the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.
she ceramics reserves the right to adapt or amend these GTC at any time if necessary.
The copyright to the website www.she-ceramics.ch and all its content, including text, images and source code, is owned in full by she ceramics. It is not permitted to copy, download or otherwise use parts of it for your own purposes without express written permission.
Should a provision of this contract or a supplement to this contract be or become invalid, this shall not affect the validity of the remainder of the contract. The contracting parties shall replace the invalid provision with a valid provision that comes as close as possible to the intended economic purpose of the invalid provision. The same applies to any contractual loopholes.

The membership application is made in writing. By signing the application, the member recognises the General Terms and Conditions. Applications will be considered in the order in which they are received and confirmed in writing.
Membership is valid after receipt of the written confirmation (e-mail) and acknowledgement of the General Terms and Conditions, which are signed by hand.
The membership subscription includes 30 hours per month access to the studio and the use of all equipment. Unused hours cannot be carried over to the following month. It is also not possible to make up missed hours due to a holiday absence. Members who have not attended a course at she ceramics and wish to join the Open Studio directly must complete a compulsory introductory lesson of CHF 50.
In the event of illness or an accident lasting 14 days or more, the membership can be paused for the duration of the subsequent absence. Membership can also be paused in the event of parental leave. This must be communicated immediately in writing to hoi@she-ceramics.ch. A medical certificate must be submitted in all cases.
The subscription can be interrupted in the event of long-term leave or for compelling professional reasons (only from a duration of eight weeks). This requires early notification and agreement with she ceramics. A small administration fee will be charged.
The valid prices are set out on the website www.she-ceramics.ch. she ceramics reserves the right to increase the membership prices if necessary. Members will be informed in writing 14 days before the price increase.
Subscriptions of 6 months or more may bring one person per year free of charge for a one-off use of the studio. Please notify hoi@she-ceramics.ch of this in advance. The material costs will be charged to the member.
The material costs are CHF 35 per kilo fired (incl. clay, glaze, firing). Clay objects without glaze cost CHF 25 per kilo fired.
The light-coloured Westerwald stoneware clays are prepared by she ceramics. The black Westerwald stoneware clay is prepared by the members themselves.
By signing the contract, the member undertakes to pay the cost of the subscription by bank transfer or cash payment. For 3-month subscriptions, the full amount is due in advance. For 6 and 12 month subscriptions, the first 3 months are due in advance. The remaining months are paid monthly by bank transfer. Of course, the full membership amount can also be debited in advance.
The payment of the membership subscription costs is independent of whether the member uses the studio or not.
Cancellations (withdrawals) and resignations must be made in writing in accordance with these General Terms and Conditions (stefanie@she-ceramics.ch) and must be made at least four weeks before the membership expires.
In the event of cancellation of an ongoing membership offer, there is no entitlement to reimbursement of the costs or any part thereof.
The contract between the member and the studio for the membership is binding for the agreed term. Premature cancellation of the subscription is not possible unless there is an important reason, such as an unforeseen serious illness or a move to a region where the subscription is not available. In this case, cancellation is possible, but only upon presentation of appropriate proof.
Members who do not comply with the conditions may be excluded from the membership contract. There is no entitlement to reimbursement of the costs or any part thereof. she ceramics reserves the right to deny a member access to the studio if the conditions are not complied with.
she ceramics reserves the right to vary the opening hours depending on the occasion (courses, workshops, special events, etc.). Members can see the available times via the scheduling tool.
The studio is generally open from 8:00 in the morning until 22:00 at night. As she ceramics is located in a residential neighbourhood, we ask that you keep to these times and behave respectfully.
If no one is on site during the Open Studio opening hours, members enter the studio using the key in the key safe. Members enter she ceramics at their own risk and are aware of the risk of injury (sharp objects, hot air blow dryers, etc.).
The kilns are operated exclusively by a small number of trained persons. They reserve the right not to fire any items for which the glazes have not been properly applied (floor not properly cleaned, etc.).
No objects may be placed on the kiln at any time. Defects in the kiln (due to incorrectly placed objects or glazes applied too thickly, etc.) will be charged.
Every member is obliged to remove clay and glaze residues from used work surfaces. As well as to clean work areas and the floor. It is expected that workplaces are left as they were found. This serves to minimise the fine dust from clay and glaze powder and contributes to everyone’s health. Smoking is not permitted in the studio.
Children under the age of 16 may only enter she ceramics when accompanied by an adult.
By accepting the general terms and conditions, members agree to follow the safety instructions at all times.
In general, she ceramics accepts no liability whatsoever if personal items are lost or damaged in the studio. Members are responsible for taking out accident insurance and personal liability insurance for all activities at she ceramics. she ceramics accepts no liability for injuries or accidents.
Swiss law applies to all legal disputes in connection with a Membership with she ceramics. Place of jurisdiction is Zurich.
